La personne de confiance

I want to designate a trusted person.
How to do it?

Article L. 1111-6 of the French Public Health Code clearly states that you have the right to designate a trusted person. This person can be a family member or friend, for example, or even your doctor.

During any hospitalization in a healthcare establishment, the patient is normally asked to designate a trusted person.

What is the purpose of the trusted person?

A trusted person is consulted when you are unable to express your wishes. This person records your wishes, and their testimony prevails over any other testimony. This person can also assist you in your efforts.

How can I designate my trusted person?

The designation is made in writing and co-signed by the designated person. It is valid without limitation of duration, unless the adult or the trusted person provides otherwise. It is revisable and revocable at any time.

I am a protected adult, can I designate a trusted person?

When a person is subject to a legal protection measure with representation relating to the person, they may designate a trusted person with the authorization of the judge or the family council if one has been established.

If the trusted person was designated before the protection measure, the family council, if applicable, or the judge may confirm the designation of this person or revoke it.
